Please read the following important Terms of Service Agreement (the "Agreement") before accessing or using any of the various services (the "Services") made available to you (the "Member") by Pricesbolo through http://www.pricesbolo.com ("pricesbolo") will be legally bound by this Agreement. If you are a minor, your parent or guardian must read and accept the terms of this Agreement before you register. No Member may participate where doing so would be prohibited by any applicable law or regulation.

Pricesbolo reserves the right to modify or amend this Agreement at any time, for any reason, or for no reason at all, at Pricesbolo’s sole discretion. The most recent version of this Agreement will be posted on the Pricesbolo website. Although Pricesbolo will provide notice of material changes to this Agreement on the Pricesbolo website, as a Member it is your sole responsibility to keep yourself appraised of any such modifications or amendments. Should Member object to any terms and conditions of the Agreement or any subsequent modifications thereto or become dissatisfied with Pricesbolo in any way, Member's only recourse is to immediately:

Modifications

• discontinue use of Pricesbolo;
• terminate Pricesbolo registration; and
• notify Pricesbolo of termination.

Description of Services

As a Member, you will be provided with a variety of services, as described on the Pricesbolo website (the "Services"), including the ability to earn points for referring friends to the Pricesbolo website. Members may also utilize certain additional services offered from time to time such as mobile communications, merchant information, price notification and various informational services. Pricesbolo reserves the rights to enhance, modify, or discontinue the Services, in whole or in part, at any time, for any reason, or for no reason at all, at Pricesbolo’s sole discretion, with or without notice to Members, and with no obligation to Members.

Member Conduct

Use of the Services by you, as Member, is subject to all applicable local, state, national and international laws and regulations. Pricesbolo reserves the right, but does not assume any obligation, to monitor the Services to enforce this Agreement. Nor does Pricesbolo guarantee that any monitoring it does perform will be to the Member's satisfaction. Upon learning of any violation of this Agreement, Pricesbolo, at its sole discretion, may terminate your access to and use of the Services, require you to remedy such violation, and/or take any other actions that Pricesbolo deems appropriate to enforce its rights and pursue all available remedies. Without limitation, Pricesbolo reserves the right to terminate your access to and use of the Services if, in our view, your conduct fails to meet any of the following guidelines:

• Members shall not engage in any activity that constitutes harassment, including, but not limited to, excessive repetition when listing a person, merchants and prices as a referral.
• Members shall not list the email addresses of people unknown to them.
• Members shall not list as referrals any email addresses that are fake, fictitious, or made up.
• Members shall not list as referrals any email addresses which are owned by or belong to that member.
• Members shall not enter a postal mailing address which is fictitious, invalid, or any address other than an address where that user actually receives postal mail.
• Members shall not attempt to interfere with any other person's use of the Services.
• Members shall not misrepresent their identity or impersonate any person.
• Members shall not hold themselves out as sponsored by, endorsed by, or affiliated with the Pricesbolo website.
• Members shall not use any portion of the Pricesbolo website or the Services for uploading, posting, emailing, transmitting or otherwise making available junk mail, commercial advertisements, or any other form of commercial solicitation.
• Members shall not use any portion of the Pricesbolo website or the Services for uploading, posting, emailing, transmitting or otherwise making available content, including user names, merchants and price list that are harmful, threatening, abusive, vulgar, obscene, profane, defamatory, libelous, hateful, or racially, ethnically or otherwise objectionable.
• Members shall not use any portion of the Pricesbolo website or the Services for uploading, posting, emailing, transmitting, writing reviews, forum, blogs or otherwise making available messages that are harmful to minors in any way.
• Members shall not upload photos, graphics or other content that contain or promote illegal substances or activities, including, but not limited to, underage drinking or smoking, substance abuse, weapon use, or gang affiliation.
• Members shall not post content that displays pornographic or sexually explicit material of any kind.
• Members shall not provide material that exploits people under the age of 18 in a sexual or violent manner, or solicits personal information from anyone under 18.
• Members shall not provide instructional information about illegal activities such as making or buying illegal weapons, violating someone's privacy, or providing or creating computer viruses.
• Members shall not attempt to gain unauthorized access to Pricesbolo’s database or other computer systems.
• Members shall not attempt to modify, translate, adapt, edit, decompile, disassemble, or reverse engineer any software programs used by Pricesbolo in connection with the Pricesbolo website or the Services.
• Members shall not engage in any activity that disrupts, diminishes the quality of, interferes with the performance of, or impairs the functionality of, the Services or the Pricesbolo website.
• Members shall not use any portion of the Pricesbolo website or the Services for any unlawful purpose.
• Members shall not use FREE SMS service offered by Pricesbolo for sending harmful, threatening, abusive, vulgar, obscene, profane, defamatory, libelous, hateful, or racially, ethnically or otherwise objectionable. Pricesbolo has the right to take legal action against the offender in this regard.

All judgments concerning the applicability of these guidelines shall be at the sole and exclusive discretion of Pricesbolo. Pricesbolo will remove the offending material and alert the member against repeating the offense. If another direct violation of our Terms of Agreement is committed, a member's account will be fully terminated. A member is not necessarily offered a warning. An account may be terminated at any time, without notice, depending on the severity of the offense.

Cancellation by pricesbolo.com

Please note that there may be certain orders that we are unable to accept and must cancel. We reserve the right, at our sole discretion, to refuse or cancel any order for any reason. Some situations that may result in your order being canceled include limitations on quantities available for purchase, inaccuracies or errors in product or pricing information, or problems identified by our credit and fraud avoidance department. We may also require additional verifications or information before accepting any order. We will contact you if all or any portion of your order is canceled or if additional information is required to accept your order. If your order is cancelled after your credit card has been charged, the said amount will be reversed back in your Card Account.

Cancellations by the Customer

In case we receive a cancellation notice and the order has not been processed/approved by us, we shall cancel the order and refund the entire amount. We will not be able to cancel orders that have already been processed and shipped out by us. Pricesbolo.com has the full right to decide whether an order has been processed or not. The customer agrees not to dispute the decision made by Pricesbolo.com and accept PricesBolo.com's decision regarding the cancellation.

Third Party Products

You understand and agree that there may be certain products, which will be sold on the Site by third party vendors ('Vendors'). Pricesbolo.com may not be able to control the transactions or the acts and omissions of the Vendors in such transactions. When you buy such products from Vendors on the Site the following additional terms and conditions will become applicable:

• Pricesbolo.com is not responsible for any non-performance or breach of any contract entered into between you and the Vendor. Pricesbolo.com cannot and does not guarantee that the Vendors will perform any transaction concluded on the Site.
• Pricesbolo.com does not make any representation or warranty as to the attributes (such as quality, worth, marketability etc.) of the items or services proposed to be sold on the Site by the Vendor. In particular, Pricesbolo.com does not implicitly or explicitly support or endorse the sale of any items or services on the Site. Pricesbolo.com accepts no liability for any errors or omissions, whether on behalf of itself or third parties.
• You release and indemnify Pricesbolo.com and/or any of its officers and representatives from any cost, damage, liability or other consequence of any of the actions of the Vendors on the Site and specifically waive any claims that you may have in this behalf under any applicable law. Notwithstanding its reasonable efforts in that behalf, Pricesbolo.com cannot control the information provided by other Vendors, which is made available on the Site. You may find other Vendor's information to be offensive, harmful, inaccurate, or deceptive. Please use caution, common sense, and practice safe trading when using the Site. Please note that there are also risks of dealing with foreign nationals, underage persons or people acting under false pretense.
• All other terms and conditions of this User Agreement are applicable to such transactions.

Credit Card Details

You agree, understand and confirm that the credit card details provided by you for availing of services on Pricesbolo.com will be correct and accurate and you shall not use the credit card which is not lawfully owned by you, i.e. in a credit card transaction, you must use your own credit card. You further agree and undertake to provide the correct and valid credit card details to Pricesbolo.com. Further the said information will not be utilised and shared by Pricesbolo.com with any of the third parties unless required for fraud verifications or by law, regulation or court order. Pricesbolo.com will not be liable for any credit card fraud. The liability for use of a card fraudulently will be on you and the onus to 'prove otherwise' shall be exclusively on you.

Fraudulent /Declined Transactions

Pricesbolo.com reserves the right to recover the cost of goods, collection charges and lawyers fees from persons using the Site fraudulently. Pricesbolo.com reserves the right to initiate legal proceedings against such persons for fraudulent use of the Site and any other unlawful acts or acts or omissions in breach of these terms and conditions.

Electronic Communications

Governing Law and Jurisdiction

This User Agreement shall be construed in accordance with the applicable laws of India. The Courts at Mumbai shall have exclusive jurisdiction in any proceedings arising out of this agreement.

Any dispute or difference either in interpretation or otherwise, of any terms of this User Agreement between the parties hereto, the same shall be referred to an independent arbitrator who will be appointed by Pricesbolo e-Services (India) Pvt. Ltd. and his decision shall be final and binding on the parties hereto. The above arbitration shall be in accordance with the Arbitration and Conciliation Act, 1996 as amended from time to time. The arbitration shall be held in Bangalore. The High Court of judicature at Bangalore alone shall have the jurisdiction and the Laws of India shall apply.

Reviews, Feedback, Submissions

All reviews, comments, feedback, postcards, suggestions, ideas, and other submissions disclosed, submitted or offered to Pricesbolo.com on or by this Site or otherwise disclosed, submitted or offered in connection with your use of this Site (collectively, the "Comments") shall be and remain Pricesbolo.com property. Such disclosure, submission or offer of any Comments shall constitute an assignment to Pricesbolo.com of all worldwide rights, titles and interests in all copyrights and other intellectual properties in the Comments.
